Terms of Service

These Terms of Service ("Terms") are an agreement between you and Yaohui Li, a sole proprietor operating ShotPoet ("ShotPoet", "we", "us" or "our") and govern your use of the ShotPoet website, apps and related services (the "Service"). By creating an account or using the Service, you agree to these Terms, our Privacy Policy and our Refund Policy. If you do not agree, do not use the Service.

1. The Service

ShotPoet is an AI creation tool. You describe what you want with text prompts, reference images and annotations, the Service generates images, videos or audio with AI models, and the results are kept in your Library. The models, features and formats we offer may change over time. Features marked as beta may change or be discontinued.

2. Eligibility and accounts

  • You must be at least 18 years old and able to form a binding contract to use the Service.
  • You can sign in with an email address and password, or with a Google account. Keep your sign-in details secure. You are responsible for all activity under your account.
  • Provide accurate information and keep your email address up to date. We use it for account, security and billing notices.
  • An account is for one person. Do not share, sell or transfer your account, and do not create multiple accounts to obtain extra promotional credits or get around limits.
  • Tell us promptly at support@shotpoet.com if you suspect unauthorized use of your account.

3. Credits

  • Generations are paid for with credits. The credits required depend on the model, resolution, duration and number of results, and are shown before you start a generation.
  • Credits are deducted when a generation starts. If a result fails, the credits for that result are returned to your balance automatically.
  • Credits are a license to use the Service, not money or property. They have no cash value and cannot be sold, transferred or exchanged for cash, except where a refund is available under our Refund Policy or required by law.
  • Credits are sold in one-time credit packs. Larger packs may include bonus credits, which are used the same way as purchased credits.
  • Purchased credits, including bonus credits, do not expire while your account remains open.
  • Promotional credits may have their own conditions, including an expiry date, shown when they are granted.
  • If your account is closed for violating these Terms, any remaining credits are forfeited.

4. Purchases and payments

Our order process is conducted by our online reseller Paddle.com, which is the Merchant of Record for all our orders. Paddle processes your payment, issues your receipt or invoice, collects applicable taxes, and handles billing inquiries and refunds. Your purchase is also subject to the Paddle Buyer Terms.

  • Prices are shown before you pay. Depending on where you live, sales tax or VAT may be added at checkout.
  • Credit packs are one-time purchases. They do not renew, and you are not charged again unless you buy another pack.
  • Credits are added to your balance right after the payment is confirmed.
  • The prices of credit packs and the credits each model requires may change. Current prices are shown on our pricing page and before each generation, and changes do not affect purchases you have already made.
  • Refunds are handled under our Refund Policy.

5. Your content

"Inputs" are the prompts, reference images, annotations and other material you submit. "Outputs" are the images, videos, audio and other results generated for you. Together they are "your content".

  • You keep all rights you have in your Inputs. As between you and us, and to the extent permitted by law, you own your Outputs, and we assign to you any rights we may have in them.
  • You may use your Outputs for any lawful purpose, including commercial use.
  • You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit and display your content only as needed to provide, maintain, secure and support the Service. This includes sending Inputs to model providers to generate Outputs and creating preview copies of Outputs.
  • Your Library is private to your account. We do not publish your content or use it to train AI models. Authorized ShotPoet staff may access it only when needed to provide support, investigate suspected violations or comply with the law.
  • You are responsible for your Inputs and must have the rights and permissions they require, including consent from any identifiable person in the images you upload.
  • AI models can produce similar Outputs for different users, and your rights do not extend to Outputs generated for others. Depending on where you live, AI-generated material may not be protected by copyright.
  • Review Outputs before you rely on or publish them. You are responsible for how you use them, including making sure they do not infringe the rights of others.

6. Acceptable use

You must not use the Service to create, upload or share content that:

  • sexualizes minors in any way, including fictional or AI-generated depictions. We report such material to the relevant authorities.
  • shows a real person nude, in a sexual situation or in other intimate imagery without their consent.
  • impersonates a real person or depicts them in a way intended to deceive, defraud, harass or harm their reputation, including fabricated news, election disinformation and fake endorsements.
  • infringes copyright, trademark, privacy, publicity or other rights.
  • promotes terrorism, violent extremism or self-harm, or threatens, harasses or incites hatred or violence against any person or group.
  • facilitates fraud, scams, weapons, illegal drugs or other illegal activity.

You also must not:

  • bypass or probe safety filters, rate limits, credit charges or other restrictions.
  • access the Service with bots, scrapers or other automated means, except through interfaces we provide for that purpose.
  • copy, reverse engineer or resell the Service, or use the Service or its Outputs to build a competing AI model or service.
  • interfere with the Service or its infrastructure, including by uploading malware or placing an unreasonable load on our systems.
  • present Outputs as made by a human where the law requires AI-generated content to be disclosed.

Model providers apply their own safety systems and usage policies, which may block a prompt or a result; a blocked result counts as failed and its credits are returned. We may block generations, remove content or suspend accounts that violate this section. To report content that infringes your rights or violates these Terms, email support@shotpoet.com with enough detail for us to find it.

7. Third-party services

The Service relies on third parties, including AI model providers, Google Sign-In, cloud hosting and Paddle. Their services are governed by their own terms, and we are not responsible for their availability or conduct. A model or feature may become unavailable if its provider changes or discontinues it.

8. Our intellectual property

The Service, including its software, design, and the ShotPoet name and logo, belongs to us or our licensors and is protected by law. These Terms do not give you any right to use our name or logo. If you send us feedback or suggestions, we may use them without any obligation to you.

9. Suspension and termination

  • You can stop using the Service at any time. To close your account and delete your data, email support@shotpoet.com from the address on your account.
  • We may suspend or close your account, or refuse a generation, if you violate these Terms, if your use creates risk or legal exposure for us or others, if a payment is reversed or charged back, or if the law requires it. Where appropriate, we will tell you the reason and give you a chance to respond.
  • When your account is closed, your right to use the Service ends and any remaining credits are forfeited, except where our Refund Policy or the law provides otherwise. Your content is then deleted as described in our Privacy Policy.
  • Sections that by their nature should continue to apply, including those on your content, disclaimers, liability and disputes, survive termination.

10. Disclaimers

The Service and all Outputs are provided "as is" and "as available". AI models can produce results that are inaccurate, unexpected or unsuitable, and we do not guarantee any particular result. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not warrant that the Service will be uninterrupted, secure or error-free.

11. Limitation of liability

To the fullest extent permitted by law, ShotPoet will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from or related to the Service. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or USD 100. These limits do not apply to liability that cannot be limited under applicable law.

12. Indemnity

To the extent permitted by law, you agree to defend and indemnify ShotPoet against claims, losses and expenses, including reasonable legal fees, arising from your content, your use of the Service or Outputs, or your violation of these Terms or the rights of others.

13. Disputes

If you have a concern, contact us first at support@shotpoet.com, and we will try to resolve it informally within 30 days. If you are a consumer, you keep the protection of the mandatory laws of your country of residence and may bring a claim in the courts where you live. Nothing in these Terms affects your statutory rights as a consumer.

14. Changes to these Terms

We may update these Terms as the Service changes or as the law requires. We will post the updated Terms on this page and change the date at the top. If a change materially affects your rights, we will notify you by email or in the Service at least 14 days before it takes effect, unless the law requires it sooner. If you keep using the Service after the change takes effect, you accept the updated Terms; if you do not agree, you can stop using the Service and close your account.

15. General

These Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a merger, acquisition or sale of the Service. We are not liable for delays or failures caused by events beyond our reasonable control.
